Divorce v. Separation

A legal separation and a divorce accomplish the same results concerning property and debt division, custody, and child/spousal support.  However, at the completion of the case the parties remain married.  In some cases parties do not want to terminate their marriage, but in all other aspects do not want to remain legally obligated to or for their spouse.  This may be because of a lawsuit involving one spouse, health insurance needs, or even spiritual reasons.

Asset/Debt Division

In general assets and debts acquired during marriage are “community” in Missouri.  Thus, the assets and debts are equally divided upon marriage termination.  However, there are many nuances that can affect the general rule.  For example, an inheritance or gift during marriage are presumed to be and can remain separate property.  Contributions of separate property to the “community estate” (for example, a home improvement of the community home with an inheritance) may be protected and reimbursed to the gifting party upon marriage termination.  The rules can be complex and sound legal counsel is essential to a successful case.

Custody

Perhaps the worst party of an “ugly divorce” is a custody dispute.  More often than not a parent confuses anger against the other party for a perception of what’s best for the children, resulting in arguments that often are ridiculous or have no relevance under the law.  We encourage parties to put their emotions aside and consider what’s best for the children.  In many cases, the other side is unable to do that.  Aggressive representation to make reasoned arguments to the court is critical to a successful case.

Generally, the court has four options in determining custody of children. It may order the parents to share joint legal custody and/or joint physical custody, and may order that one parent receive sole legal custody and/or sole physical custody, with the other parent receiving visitation with the children. The court can order these legal and physical custody designations in any combination it sees fit to best promote the best interests of the children.

When there are children involved, the court will need to enter orders relating to child custody. In doing so, the court looks to establish a custody order that promotes frequent and meaningful contact with both parents, and encourages parents to share in the decision-making rights and responsibilities of the children.

Support

Child and spousal support is often a contested issue.  Although the law sets forth formulas and guidelines for the court to use, there can often be an attempt to manipulate facts by altering income, working for cash, or outright misrepresentation.  Forensic accounting work can be helpful to sift through so the truth gets to the judge.

Drew Williams Professional Background

Drew began focusing on family law during his second semester of law school. He graduated law school with an emphasis on Child and Family Law, obtained membership into the Order of Barristers, and was honored with the Child and Family Services Clinic Outstanding Student Award. After finishing law school, Drew worked as a law clerk in the 16th Circuit Court of Jackson County, Missouri, where he assisted the judge in handling Jackson County’s family law and domestic relations dockets.

In 2016, Drew began working as an associate attorney at Todt, Ryan, Cody, and Fuchs, LLC in St. Charles, Missouri. While there, he gained invaluable experience and mentorship in litigating divorce and family law cases. In 2019, Drew accepted a position as Litigation Attorney with domestic litigation firm Cordell & Cordell in St. Louis, Missouri. During his time at Cordell & Cordell, Drew managed a large case load where he continued to build, hone, and refine his approach to divorce and family law matters.

In 2022, Drew began Williams Legal Services with the goal of creating a platform to provide exceptional representation to clients in family law and estate planning matters.
